Construction Client Fined for Breaches of Construction (Design & Management) Regulations 2007.

The Health and Safety Executive has recently brought a prosecution against a Construction Client for failing to appoint a competent CDM Co-ordinator and Principal Contractor as is required under the Construction (Design & Management) Regulations 2007.
City of London Magistrates heard how the Company’s failings contributed to an unsafe working environment, so leading to a labourer falling from height.
The Construction Client was fined a total of £13,000.
The client holds the purse strings and therefore can influence the critical decision making process in how a construction project is planned, managed and executed.
This prosecution serves as a warning to those clients who do not take their legal duties and responsibilities seriously.
Commercial clients must always appoint competent designers, contractors and a CDM co-ordinator to ensure that the new build, refurbishment, maintenance or de-commissioning and demolition of all commercial buildings are carried out in a safe manner.
“Proper planning together with management and control measures are key to providing a safe working environment,” says John Lawrence of Tennyson Suite. “It’s paramount that the right information is provided to the right people at the right time.”
