Estate Agent Fined After Maintenance Worker Falls Through Fragile Roof.
 
Estate Agents who manage properties on behalf of Landlords are warned that they have a legal responsibility for their maintenance workers, whether directly employed or not, when employing them to undertake maintenance, repair and construction works on their managed properties.
 
This follows a recent criminal court case where Estate Agents, Morris Marshall and Poole were fined £75,000 and ordered to pay nearly £12,000 costs having following a conviction by the HSE of failing to comply with Section 3.1 of the Health and Safety at Work Act.
It was heard in court that the Estate Agents failed to ensure that the contractor employed was competent to carry out working at height and that the Company had failed in its duty to properly plan and organise the work.

The Work at Height Regulations 2005 requires that:
• the work is properly planned and organised
• the task is carried out by a competent person
• the activity is risk assessed and the selection and use of appropriate access equipment is suitable for the purpose
• the work at height is properly managed where working adjacent to fragile surfaces
• equipment used to gain access and provide working platform for working at height is properly inspected and maintained by a competent person
